1. Acceptance of Terms

By accessing or using our website and photo restoration services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

We reserve the right to update or modify these Terms at any time. We will notify registered users of material changes via the email address associated with their account. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least thirteen (13) years of age to create an account and use this Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian, and that parent or guardian must agree to these Terms on your behalf.

By creating an account, you represent and warrant that you meet the eligibility requirements stated above. We reserve the right to terminate accounts that we reasonably believe are operated by individuals who do not meet these requirements.

3. Account Registration and Security

To use the Service, you must create an account. Account creation and authentication are managed by Clerk, a third-party authentication provider. You may register using an email address and password, or through Google authentication, both facilitated by Clerk.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You must notify us immediately of any unauthorized use of your account.

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

4. Description of the Service

The Service allows you to upload photographs ("Photos") for digital restoration and enhancement. Photos you upload are processed using third-party artificial intelligence technology provided by Google (specifically, Google Vertex AI).

We do not guarantee any specific outcome or level of restoration quality. Results may vary depending on the condition, resolution, and format of the original Photo. The Service is provided on an "as-is" basis.

5. Tokens and Payment

5.1 Purchasing Tokens

The Service operates on a token-based system. You may purchase tokens through the Service, with all payments processed securely by Stripe, Inc. ("Stripe"). One (1) token is consumed per Photo restoration. Token prices are displayed at the point of purchase and may change at our discretion. Price changes do not affect tokens already purchased.

5.2 Refund Policy

All token purchases are final and non-refundable, except as required by applicable law. If you experience a technical failure during processing that consumes a token without producing a result, you may contact us to request a token credit at our discretion.

5.3 Token Expiration

Purchased tokens do not expire so long as your account remains active and in good standing.

5.4 Account Deletion and Tokens

If you delete your account, all unused tokens are permanently forfeited and cannot be recovered or refunded. You are advised to use all tokens prior to account deletion.

6. Photo Upload and Content Ownership

6.1 Your Content

You retain all ownership rights to the Photos you upload. By uploading a Photo, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit the Photo solely for the purpose of performing the restoration service. This license terminates when the Photo is deleted from our systems.

6.2 Acceptable Use

You represent and warrant that you own or have the necessary rights and permissions to upload each Photo, and that the Photos do not contain content that is illegal, obscene, defamatory, or that infringes upon the intellectual property or privacy rights of any third party.

6.3 Prohibited Content

You may not upload content that:

  • Depicts child sexual abuse material (CSAM) or the exploitation of minors in any form
  • Violates any applicable local, state, national, or international law
  • Infringes upon the intellectual property rights of any third party
  • Contains malware, viruses, or any harmful code

We reserve the right to refuse processing, remove content, and terminate accounts that violate these restrictions without notice or refund.

7. Photo Retention and Deletion

Both original and restored Photos are retained on our servers for a period of thirty (30) days from the date of processing to allow you to download your restored Photos.

After the 30-day retention period, all Photos (original and restored) are automatically and permanently deleted from our servers. This is a hard deletion; Photos are not recoverable after this point.

If you delete your account, all associated Photos are permanently deleted immediately, regardless of how much time remains in the 30-day retention window.

You are solely responsible for downloading your restored Photos within the 30-day retention period. We are not liable for any loss resulting from failure to download Photos before deletion.

8. Third-Party Services

The Service relies on the following third-party providers:

  • Google Vertex AI: Used to process and restore your Photos. Google's terms of service and privacy policy apply to their processing of your data. Per Google Cloud's current data processing terms, Photos processed through Vertex AI are not used to train Google's AI models.
  • Stripe: Used to process all payments. Stripe's terms and privacy policy govern payment processing. We do not store your full payment card details on our servers.
  • Supabase: Used for data storage infrastructure. Supabase's terms and policies apply to their hosting services.
  • Clerk: Used for account creation, authentication, and session management. Clerk's terms of service and privacy policy govern their handling of your authentication data.
  • Google Authentication: If you use Google sign-in (facilitated through Clerk), Google's terms and privacy policy apply to the authentication process.

We are not responsible for the practices, policies, or availability of these third-party services. Changes to third-party terms or services may affect the functionality of our Service.

9. Intellectual Property

Except for the Photos you upload, all content, features, and functionality of the Service (including but not limited to text, graphics, logos, software, and design) are owned by us or our licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written consent.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not warrant any specific results from the use of the Service.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply only to the fullest extent permitted by applicable law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or third parties, or for any other reason we deem appropriate.

You may terminate your account at any time through the account settings. Upon termination, all Photos are immediately and permanently deleted, and all unused tokens are forfeited.

Sections 6.1 (to the extent of any surviving license), 10, 11, 12, 14, and 15 shall survive termination of these Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association, with arbitration to take place in Santa Clara County, California.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

15. General Provisions

Severability. If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
